Curb Report is an informational platform only. We are not a licensed financial advisor, broker, dealer, or real-estate agent. Nothing on this site or in any communication from us constitutes financial, investment, legal, tax, or real estate advice. Real estate investments carry significant risk, including the risk of total loss. Always conduct your own due diligence and consult qualified, licensed professionals before making any investment, financial, or property decisions.
These Terms of Service ("Terms") form a binding agreement between you ("you", "your", or "User") and Curb Report ("Curb Report", "we", "us", or "our") regarding your access to and use of the Curb Report website, applications, data, and related services (collectively, the "Services"). By accessing, registering for, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
1. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Services. By using the Services, you represent and warrant that (a) you meet these eligibility requirements, (b) all information you provide to us is accurate and current, and (c) your use of the Services will comply with these Terms and all applicable laws and regulations.
2. Description of Services
Curb Report provides real estate market data, analytics, composite scores, time-series visualizations, AI-generated narratives, and related informational tools. The Services aggregate, transform, and present data sourced from public records and licensed third-party providers, including (without limitation) Zillow, Redfin, Realtor.com, the U.S. Census Bureau, the Federal Reserve Economic Data (FRED), the Bureau of Labor Statistics, HUD, FEMA, FBI, FCC, and EPA. The Services are intended to support market research and education. The Services are not, and are not intended to be, a substitute for professional advice.
3. No Financial, Investment, Legal, Tax, or Real Estate Advice
All content, data, analytics, scores, forecasts, AI-generated narratives, recommendations, and other materials provided through the Services are for general informational and educational purposes only. Curb Report is not, and does not hold itself out as, any of the following: a registered investment adviser, broker-dealer, real estate broker or agent, mortgage broker, financial planner, fiduciary, attorney, certified public accountant, tax advisor, or appraiser.
Nothing on the Services constitutes, or should be construed as: (a) an offer or solicitation to buy or sell any real estate, security, or other financial instrument; (b) personalized investment advice, financial planning, or a recommendation regarding any specific property, market, security, or strategy; (c) legal, tax, accounting, appraisal, or real estate brokerage advice; or (d) a guarantee, warranty, or assurance of any particular outcome, return, or result.
You acknowledge and agree that any decision to purchase, sell, hold, finance, or invest in any real estate or related asset is made by you in your sole discretion and at your sole risk. You are solely responsible for evaluating the merits and risks of any decision. You should always conduct your own independent research and consult appropriately licensed professionals (including real estate agents, attorneys, accountants, mortgage advisors, and inspectors) before making any decision based on information from the Services.
4. Data Accuracy, Forecasts, and Insight Scores
The Services rely on data obtained from third parties and public records. While we strive to deliver high-quality information, we do not independently verify all source data, and we make no representations or warranties regarding the accuracy, completeness, timeliness, reliability, suitability, or availability of any data, metric, score, narrative, or other content presented on the Services.
Forecasts and Insight Scores (including but not limited to Price Forecast, Long-Term Growth, Buyer Power Index, Market Heat, Crash Risk, Investment Score, Livability Score, Opportunity Score, and Momentum Score) are statistical estimates derived from historical and current data using proprietary models. They are not predictions of future events, returns, or property values. Real estate markets are influenced by many factors that no model can fully anticipate, including macroeconomic conditions, interest rates, regulatory changes, local events, and individual property characteristics.
Past performance is not indicative of future results. The fact that a market, score, or metric has historically behaved in a particular way does not mean it will continue to do so. AI-generated narratives and recommendations are produced by a large language model and may contain errors, omissions, hallucinated facts, or biases. You should treat all AI output as a starting point for your own research, never as a final conclusion.
We reserve the right to add, modify, suspend, or remove any data source, metric, score, or feature at any time without notice.
5. Accounts and Security
To access certain features, you must create an account. You agree to (a) provide accurate, current, and complete information; (b) maintain and promptly update that information; (c) keep your password and authentication credentials confidential; (d) take responsibility for all activities that occur under your account; and (e) notify us immediately at support@curb-report.com of any unauthorized use of your account or any other suspected security breach. We are not liable for any loss or damage resulting from your failure to comply with these obligations.
6. Subscriptions and Billing
Curb Report offers free and paid subscription tiers. Paid subscriptions are processed through Stripe, Inc., our payment processor. By providing payment information, you authorize us (acting through Stripe) to charge the applicable fees to your selected payment method.
- Billing cycle. Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select, starting from the date you subscribe.
- Auto-renewal. Paid subscriptions automatically renew at the end of each billing period at the then-current price until canceled. You authorize us to charge your payment method for each renewal without further notice or action by you.
- Renewal reminders. Our payment processor (Stripe) will send a reminder email to your account address in advance of each renewal for annual subscriptions, and will notify you if your payment method is about to expire or if a charge fails. We are not responsible for failed delivery of such reminders (e.g., spam filtering, outdated email address). It remains your responsibility to keep your email address current and to cancel before the renewal date if you do not wish to be charged.
- Receipts. Stripe will email you a receipt for each successful payment, including renewals.
- Cancellation.You may cancel your subscription at any time, with no penalty, through your account's Billing page. Cancellation takes effect at the end of your current billing period; you will retain access to paid features until that date. We will not charge you for the next billing period once you cancel.
- Price changes.We may modify subscription pricing at any time. We will provide at least 30 days' notice (via email or in-product notification) before any price increase takes effect for existing subscribers. Your continued use after the effective date constitutes acceptance of the new price.
- Failed payments.If a payment fails, we may suspend, downgrade, or terminate your paid access until payment is resolved. We may also retry the charge in accordance with Stripe's automatic-retry logic.
- Taxes. Fees are exclusive of any applicable taxes. You are responsible for any sales, use, value-added, or similar taxes imposed by your jurisdiction.
- Complimentary access. We may grant promotional or complimentary access to paid features at our sole discretion, and we may revoke such access at any time.
7. No Refund Policy
Please carefully review your order before confirming your purchase. All sales are final. Curb Report does not offer refunds, credits, or exchanges for any subscription fees, including partial-period refunds for cancellations made mid-billing-cycle.
This policy applies to:
- Monthly subscription fees, regardless of how much of the billing period has elapsed;
- Annual subscription fees, regardless of when during the annual period you cancel;
- Auto-renewal charges, including charges that occur because you did not cancel before the renewal date;
- Charges incurred while you did not actively use the Services.
Your remedy if you no longer wish to be charged is to cancel your subscription through the Billing page. Cancellation takes effect at the end of your current billing period, after which you will not be charged again. You will continue to have access to paid features until the end of the already-paid period.
Limited exceptions. At our sole discretion, we may issue a refund (in whole or in part) in cases of (a) duplicate charges resulting from a billing system error; (b) an inability to access the Services that we have confirmed is attributable to our systems; or (c) other circumstances where a refund is required by applicable law. Granting a refund in one instance does not obligate us to grant a refund in any other instance.
EU/UK customers. If you are a consumer residing in the European Union or United Kingdom, you may have a statutory right to withdraw from the contract within 14 days of purchase. By starting to use the Services immediately upon purchase, you expressly acknowledge and consent to the immediate commencement of performance and waive your right of withdrawal to the extent the Services have been fully performed during that period.
Chargebacks. If you initiate a chargeback or payment dispute with your card issuer without first contacting us to attempt resolution, we reserve the right to suspend or terminate your account and recover the disputed amount through any lawful means.
8. Acceptable Use
You agree not to:
- Use the Services for any unlawful, fraudulent, or harmful purpose, or in violation of any applicable laws, regulations, or third-party rights;
- Scrape, crawl, harvest, index, mirror, or use automated means (including bots, spiders, or AI agents) to access the Services or extract data beyond what is provided through our intended interfaces, except as permitted by a documented API or written agreement with us;
- Resell, redistribute, sublicense, lease, share, or otherwise commercially exploit any data, metric, score, or content obtained from the Services without our prior written consent;
- Use the Services to provide a competing product or service, or to train or fine-tune any machine learning model;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or methodologies underlying the Services;
- Interfere with, disrupt, or impose an unreasonable load on the Services, including by attempting to gain unauthorized access, introducing malware, or bypassing security measures;
- Share account credentials, sell or transfer your account, or use the Services on behalf of any third party without proper authorization;
- Make any false, misleading, or defamatory statements about Curb Report or any market, neighborhood, or person on or through the Services;
- Use the Services to engage in or facilitate any form of housing discrimination prohibited by the Fair Housing Act or other applicable laws (including discrimination based on race, color, national origin, religion, sex, familial status, disability, or any other protected characteristic).
9. AI-Powered Features
Certain features of the Services use third-party large language models and other artificial-intelligence systems to generate narratives, summaries, and recommendations. AI output is probabilistic and may be inaccurate, incomplete, biased, or fabricated ("hallucinated"). We do not warrant the accuracy of AI output. You must independently verify any AI-generated content before relying on it for any purpose. AI-generated content is not legal, financial, tax, real estate, or other professional advice, and using such content for those purposes is at your sole risk.
10. Intellectual Property
The Services, including all software, code, content, design, user interfaces, analytics methodologies, Insight Scores, graphics, logos, trademarks, and other materials (collectively, "Curb Report Materials"), are owned by Curb Report or its licensors and are protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services solely for your personal or internal business purposes, subject to these Terms. All rights not expressly granted are reserved.
You retain ownership of any content you submit to the Services (e.g., support messages, profile information, "User Content"). By submitting User Content, you grant Curb Report a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, copy, modify, distribute, and display that User Content solely as necessary to operate, improve, and provide the Services. You represent that you have all rights necessary to grant this license.
11. Third-Party Data and Attribution
The Services aggregate, transform, and present data obtained from a variety of third-party sources, including without limitation: Zillow Research (real-estate market data), Redfin Data Center, Realtor.com Research, the U.S. Census Bureau (including the American Community Survey, Building Permits Survey, and County Business Patterns), the Federal Reserve Economic Data (FRED) service of the Federal Reserve Bank of St. Louis, the U.S. Bureau of Labor Statistics (BLS), the U.S. Department of Housing & Urban Development (HUD), the Federal Emergency Management Agency (FEMA), the U.S. Environmental Protection Agency (EPA), the National Oceanic & Atmospheric Administration (NOAA), the U.S. Department of Agriculture (USDA), the Federal Bureau of Investigation (FBI Uniform Crime Reporting), the Federal Communications Commission (FCC), the Health Resources & Services Administration (HRSA), the Internal Revenue Service (IRS Statistics of Income), the Tax Foundation, the National Association of Insurance Commissioners (NAIC), the MIT Election Data and Science Lab, and the National Conference of State Legislatures (NCSL). Curb Report is not affiliated with, endorsed by, or sponsored by any of the third-party data sources listed above. All product names, logos, trademarks, and brands that may appear in the Services or in attribution lists are the property of their respective owners and are referenced solely for the purpose of source attribution.
Each third-party source publishes data under its own terms. Public-domain U.S. federal government data is reproduced and transformed without restriction under 17 U.S.C. § 105. Permissively-licensed research data (e.g., Zillow Research, Redfin Data Center) is used in accordance with each provider's published attribution requirements. Curb Report does not redistribute raw third-party datasets — the Services display derived metrics, computed scores, and aggregated visualizations.
We do not own, control, endorse, or assume responsibility for the accuracy, completeness, legality, or quality of any third-party data or third-party websites linked from the Services. Your use of any linked third-party service is governed solely by the applicable third-party terms.
If you represent a data source listed above and wish to request a change to our attribution, or removal of any dataset, please contact legal@curb-report.com. We will respond within 5 business days.
12. Disclaimer of Warranties
The Services are provided "as is" and "as available".
To the maximum extent permitted by applicable law, Curb Report and its officers, directors, employees, agents, affiliates, suppliers, and licensors disclaim all warranties, express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Services will meet your requirements, that any defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions apply to the maximum extent permitted by law.
13. Limitation of Liability
Please read this section carefully — it limits the amount and types of damages you can recover from us.
To the maximum extent permitted by applicable law, in no event shall Curb Report, its officers, directors, employees, agents, affiliates, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, savings, investment returns, real estate value, or use, arising out of or in connection with these Terms or your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages, and regardless of the theory of liability (whether in contract, tort, strict liability, or otherwise).
Without limiting the foregoing, our total cumulative liability to you for all claims arising from or related to these Terms or the Services, regardless of the form of action, shall not exceed the greater of (a) the total amount you paid to Curb Report in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you to the extent prohibited.
14. Indemnification
You agree to defend, indemnify, and hold harmless Curb Report and its officers, directors, employees, agents, affiliates, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the Services; (b) your breach of these Terms; (c) your violation of any applicable law or third-party right; or (d) any decision you make or action you take in reliance on content provided through the Services.
15. Assumption of Risk
You acknowledge that real estate investing and related activities involve significant financial risk, including the risk of partial or total loss. You voluntarily assume all risk associated with any decision you make based in whole or in part on information from the Services. You agree that Curb Report has no responsibility or liability for any losses, damages, or adverse outcomes you may experience.
16. Suspension and Termination
We may suspend, restrict, downgrade, or terminate your access to the Services at any time, with or without notice, for any reason or no reason, including (without limitation) any actual or suspected violation of these Terms, non-payment, or our discontinuation of the Services. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination — including Sections 3, 4, 7, 10, 12, 13, 14, 15, 18, and 19 — shall survive.
17. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice by updating the "Last Updated" date above and, where feasible, by notifying you by email or through the Services. Your continued use of the Services after the effective date of any updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, your sole remedy is to stop using the Services and cancel any paid subscription.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution. Before filing a claim against Curb Report, you agree to attempt informal resolution by contacting us at legal@curb-report.com and giving us at least 60 days to address the issue.
Binding arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the Services that is not resolved informally shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English, on a documents-only basis where permitted, otherwise in your county of residence or another mutually agreed location. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and Curb Report agree that any dispute will be brought in your or our individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.
30-day opt-out. You may opt out of the arbitration and class-action waiver provisions of this Section 18 by sending written notice to legal@curb-report.com within 30 days of first accepting these Terms. Your opt-out notice must include your full name, account email, and a clear statement that you wish to opt out. If you opt out, all other parts of these Terms continue to apply.
19. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Curb Report regarding the Services.
- Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- Assignment. You may not assign these Terms or any rights hereunder without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
- Force majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, network failures, or acts of governmental authority.
- Notices. We may give notices through the Services, by email to the address associated with your account, or by any other reasonable means.
- Headings. Section headings are for convenience only and have no legal effect.
